Effective July 1, 2009, the intention to register a fictitious name must be advertised at least once in a newspaper in the county in which the principal place of business is to be located. This publication must be run prior to filing the fictitious name with the Division of Corporations.

Florida Publication Process:

Legal notice is prepared meeting all requirements of the publishing statute of Florida.
Place the publication notice in one newspaper of general circulation.
Obtain affidavits of publication from the newspaper.
Affidavit of publication is emailed directly then original is forwarded via USPS to client.

Penalty for Not Publishing:

Failure to meet the publishing requirement may cause the corporate veil to be broken and disregarded by the state. The possibility exists that the entity could be sued but not have standing itself to sue, or the potential for an owner to be sued for business liabilities personally.

Timeline to Complete Publishing:

Expected completion is approximately 3 weeks in which we will arrange and publish your legal notice with an approved newspaper, obtain the affidavit from the publisher, and provide you with the original affidavit of publication for your official business records.

Pricing:

Price of publication is determined by the cost of the newspaper advertisement plus our service fee. The price we quote (see order form) is all inclusive there are never any extra “surprises”.
